Terms and Conditions
Last updated: 28 August 2026
These Terms and Conditions (“Terms”) govern the purchase and use of digital courses (“Courses”) offered on simwize.com (“Simwize”, “we”, “us”), operated by Hafiz Muhammad Waqas, based in Germany.
1. Scope
These Terms apply to all Courses purchased through simwize.com. Simwize offers digital, online-access educational content only. No physical products are sold.
2. Accounts
To purchase or access a Course, you must create an account. You are responsible for keeping your login credentials confidential and for all activity under your account.
3. Course Access
On successful payment, you receive a personal, non-transferable, non-exclusive license to access the purchased Course for personal learning use. Access is granted for an unlimited duration unless stated otherwise on the course page. Course content may not be copied, redistributed, resold, or shared with third parties.
4. Pricing and Payment
All prices are displayed in EUR and are inclusive/exclusive of VAT as noted at checkout, in accordance with Simwize’s applicable tax status. Payment is processed via the payment provider(s) offered at checkout. Access is granted only after payment is confirmed.
5. Right of Withdrawal / Refund Policy
You may request a refund within 7 days of purchase, provided you have completed less than 25% of the Course content, as tracked by the platform’s progress indicator. To request a refund, contact us via the contact page with your order details. Approved refunds are issued to the original payment method within a reasonable timeframe.
By actively starting a Course lesson before the 7-day period ends, you acknowledge that this may affect eligibility for withdrawal under applicable digital content regulations, to the extent permitted by law.
6. Instructor-Created Content
Some Courses may be created by third-party instructors operating on the Simwize platform. Simwize reviews such Courses before publication but is not the original author of instructor-provided content. Instructors are responsible for the accuracy of their own course material.
7. Intellectual Property
All Course content, including videos, text, and materials, is protected by copyright and remains the property of Simwize or the respective instructor. No rights are transferred to you beyond the personal access license described in Section 3.
8. Availability
We aim to keep Courses accessible but do not guarantee uninterrupted availability. Scheduled maintenance or technical issues may temporarily affect access.
9. Limitation of Liability
Simwize provides Course content for educational purposes. We are not liable for any indirect, incidental, or consequential damages arising from the use of Course content, except where liability is mandated by German law (e.g. intent or gross negligence).
10. Changes to These Terms
We may update these Terms from time to time. Continued use of purchased Courses after changes constitutes acceptance of the updated Terms.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. Place of jurisdiction, to the extent legally permissible, is Germany.
12. Contact
Questions about these Terms can be sent via the contact page at simwize.com.
